Article 1 - Definitions

In these Terms and Conditions of Use, the following terms have the meanings indicated below, unless otherwise specified:

Article 2 - Purpose

These TCU define the conditions under which the User may access the Site and use the Service. They constitute a contract between the User and the Provider.

Accessing the Site implies full and complete acceptance of these TCU. The User agrees to comply with them.

The Provider reserves the right to modify these TCU at any time. The applicable TCU are those in force at the time the Service is used.

Article 3 - Description of the Service

The Service provided by the Provider allows the User to book a taxi for a specific trip. This Service is accessible via the Site.

To use the Service, the User must fill out a booking form with the following details:

Once the booking is confirmed, an event is created in a Google Calendar and shared with an available Driver to carry out the ride.

Article 4 - Use of the Service

4.1 Access conditions

The Service is reserved for adult natural persons or legal entities. Minors may use the Service under the responsibility and with the authorization of their legal representative.

4.2 Accuracy of information

The User agrees to provide accurate, complete, and up-to-date information when using the Service. The Provider cannot be held responsible for consequences arising from inaccurate information provided by the User.

4.3 Proper use

The User agrees to use the Service in accordance with its intended purpose and these TCU, and not to infringe upon third-party rights or public order.

Article 5 - Pricing and Payment

5.1 Pricing

The applicable rates are those in effect at the time of booking. They are indicated on the Site in euros, including all taxes.

5.2 Payment methods

Payment is made directly to the driver by credit/debit card or cash.

Article 6 - Booking Cancellation and Modification

6.1 By the User

The User may cancel their booking as follows: a cancellation link is provided in the confirmation email. The User may cancel their booking at any time, free of charge and without obligation.

6.2 By the Provider

The Provider reserves the right to cancel or modify a booking in case of lack of confirmation from the client, force majeure, or exceptional circumstances. In such cases, the User will be informed as soon as possible.

Article 7 - Liability

7.1 Provider’s liability

The Provider is bound by a best-effort obligation in providing the Service. It cannot be held liable for damages resulting from:

The Provider disclaims any responsibility for the performance of the transport service, which is the sole responsibility of the Driver.

7.2 User’s liability

The User is responsible for their use of the Service and agrees to indemnify the Provider for any harm resulting from improper use in violation of these TCU.

Article 8 - Intellectual Property

All elements of the Site (texts, graphics, software, photos, images, videos, sounds, maps, names, logos, brands, creations and other protectable works, databases, etc.) are the exclusive property of the Provider or are used with permission. These elements are protected by intellectual property laws.

Any reproduction, representation, use, adaptation, modification, incorporation, translation, or commercialization, in whole or in part, of the Site’s elements without prior written authorization from the Provider is prohibited and constitutes infringement punishable under the Intellectual Property Code.

Article 9 - Personal Data Protection

The processing of personal data is subject to the Privacy Policy available on the Site.

Article 10 - Customer Service and Complaints

Article 11 - Governing Law and Jurisdiction

These TCU are governed by Spanish law.

In the event of a dispute and after attempting an amicable resolution, only Spanish courts shall have jurisdiction.

The User is informed that they may use conventional mediation or any other alternative dispute resolution method.

Article 12 - Final Provisions

If one or more provisions of these TCU are deemed invalid or declared as such pursuant to a law, regulation, or final court decision, the remaining provisions shall retain their full force and effect.

In the event of any difficulty in interpreting any of the clause titles and the clauses themselves, the titles shall be considered nonexistent.
